These terms govern your participation in the InstaWP affiliate program. They are an agreement between you and InstaWP Inc. ("InstaWP", "we", "us"), a Delaware corporation with its registered office at 3911 Concord Pike #8030, Wilmington, DE 19803.
By signing up as an affiliate, or by using a referral link we issue you, you accept these terms. If you do not accept them, do not join the program and do not promote InstaWP as an affiliate. These terms sit alongside our Terms of Service, Privacy Policy, Data Privacy notice and Refund Policy, which apply to you as well.
1. Who can join
Joining is an application, and it is subject to our approval. We review every application and decide at our discretion, so nothing is guaranteed by signing up. You can start promoting us once we approve you, and not before. You do not need a paid plan to be an affiliate, but you do need a free InstaWP account, because that is where your payout method lives.
To be eligible you must meet all of the following:
- You are at least 18 years old and can enter into a binding contract.
- You register with accurate, complete details and keep them current.
- You have an InstaWP account and can add a valid card to it as your payout method.
- You are not located in, and not acting on behalf of anyone in, a country or on a list subject to US sanctions or export controls.
- You are not a current InstaWP employee or contractor, and not an immediate family member of one.
We can decline or close an affiliate account at our discretion, including where participation would conflict with an existing commercial agreement you have with us.
Agencies that refer clients at scale are usually better served by the Agency Program, which has its own commercial terms. You cannot claim affiliate commission and agency partner benefits on the same customer.
2. Your affiliate account
One person or company gets one affiliate account. Creating extra accounts to route referrals to yourself, to reset a payout threshold, or to get around a decision we have made is grounds for closure and forfeiture of unpaid commission.
You are responsible for your login credentials and for everything done through your account. Tell us promptly at support@instawp.com if you think someone else has access.
Your account, your links and your earned commissions are personal to you. You cannot sell, rent, or transfer them without our written consent.
3. Referral links and tracking
When you join, you get a unique referral link and can manage your links from your affiliate dashboard at aff.instawp.com. Tracking works like this:
- 60-day cookie window. When someone clicks your link, a cookie is set in their browser for 60 days. If they create an InstaWP account within that window, the referral is credited to you.
- Last click wins. If a visitor clicks more than one affiliate link, the most recent one before signup gets the credit.
- A referral is tied to the account, not the person. Credit attaches to the InstaWP account created after the click.
Tracking depends on the visitor's browser accepting the cookie and on the link reaching us intact. Blocked cookies, privacy tools, a cleared browser, a signup on a different device, or a link that strips our referral parameter can all mean a referral is never recorded. We cannot credit a referral we have no record of, and our tracking records are the final word on what was earned.
Do not mask, redirect through, or rewrite your referral link in a way that hides that it is an affiliate link or that breaks the referral parameter. Ordinary link shorteners and a redirect from a page on your own site are fine.
4. What we pay
The current program pays a lifetime recurring commission. You earn on every payment a customer you referred makes, for as long as they stay with us:

Commission is calculated on the amount we actually receive and keep, after discounts, credits, and refunds, and excluding taxes, payment processing fees, and any amount later charged back. A commission becomes payable only once the underlying payment has cleared and the refund window has passed.
5. What does not earn commission
- Your own account, or an account you control, run for a related business, or sign up for on a client's behalf using your own link.
- Free plans, trial usage, promotional credits, and any period a customer does not pay for.
- Payments that are refunded, disputed, charged back, or never clear. If we have already paid you on such a payment, we deduct it from your next payout.
- An account that already existed before the click, or a customer who was already in an active sales conversation with us.
- Referrals generated through anything listed under what is not allowed.
- Taxes, transaction fees, and any third-party charges included in what a customer pays.
6. Getting paid
Commission is paid to the card you have added as your payout method in your InstaWP account. Add it before your first payout is due, and keep it valid, because we cannot pay a balance with no working payout method against it.
Approved commission is held for 45 days after the sale it relates to. Once your approved balance reaches $50 USD, it goes out to that card in the next payment round. Below $50 it rolls over to the following round.
Keeping your payout details correct is on you. We are not liable for a payment that fails or goes astray because the card on your account is wrong, expired, or closed, and we are not liable for your bank's fees, currency conversion, or processing delays.
You are an independent business. You are responsible for your own taxes on what you earn, for any registration your local law requires, and for giving us any tax documentation we reasonably need before we can pay you. Where the law requires us to withhold, we will.
If your affiliate account is inactive for 12 consecutive months with a balance under the $50 threshold, we may close it and cancel the unpaid balance. We will email you first at the address on the account.
If we believe commission was earned through fraud, a breach of these terms, or a technical error in tracking, we can withhold, reverse, or reclaim it. We will tell you why.
7. How you may promote InstaWP
Promote us anywhere your own audience already is. Typical places affiliates do well:
- Tutorials, courses, and videos about WordPress and web development.
- Reviews, comparisons, and roundups on your own site or newsletter.
- Recommendations to peers, clients, and communities you are genuinely part of.
Two rules apply everywhere you promote us:
- Disclose the relationship. Make it clear to your audience that you earn a commission, in a way that satisfies the advertising rules where you and your audience are, including the US FTC endorsement guidelines. The disclosure has to be visible before someone clicks, not buried in a footer.
- Only say things that are true. Describe our pricing, features, limits, and guarantees as they actually are. If you are unsure, check our published pages or ask us. You are responsible for keeping your claims current.
8. What is not allowed
Doing any of the following can cost you your unpaid commission and your place in the program:
- Self-referral. Using your own link for your own account, or arranging for someone to route your purchase through it.
- Paid search on our brand. Bidding on "InstaWP" or close variants and misspellings of it in any search or ad platform, or using our name in ad copy, display URLs, or the landing domain of a paid ad.
- Domains and handles that look like us. Registering domains, subdomains, app names, social handles, or profiles that contain "InstaWP" or a confusable variant, and anything that suggests you are us or speak for us.
- Unsolicited messaging. Spam email, bulk DMs, comment and forum spam, and any messaging that breaks anti-spam law such as CAN-SPAM or GDPR rules on consent.
- Cookie stuffing and forced clicks. Setting our cookie without a genuine click, hidden iframes, pop-unders, auto-redirects, toolbars, browser extensions, and adware.
- Fake discounts. Advertising coupon codes, discounts, or offers we have not published, or running coupon pages that intercept intent at checkout with codes that do not exist.
- Incentivised traffic. Paying, rewarding, or otherwise inducing people to click your link or sign up when they have no real interest, including paid-to-click and reward schemes.
- Misrepresentation. Claiming to be an InstaWP employee, reseller, or official support channel, promising things we do not offer, or copying our site to imply endorsement.
- Unsuitable placements. Promoting us on sites featuring illegal content, adult content, hate speech, harassment, malware, pirated software, or anything that would reasonably damage our reputation.
- Automated abuse. Bots, scripts, click farms, artificial traffic, and any attempt to probe or manipulate our tracking.
We may ask you where your traffic comes from and how you are promoting us, and you agree to answer honestly and promptly. Where a breach is serious or repeated, we can close your account immediately and cancel unpaid commission.
9. Using our name and logo
While you are in the program, we give you a limited, non-exclusive, revocable licence to use the InstaWP name, logo, and approved marketing assets to promote us, and only for that. Use the files as published on our brand assets page. Do not redraw, recolour, stretch, or combine our logo with your own mark, and do not register or claim any right in our marks.
Everything to do with the program, including our site, software, brand, and materials, stays ours. This licence ends the moment your participation ends, and you then stop using our marks and remove our assets from your channels within a reasonable time.
10. Our relationship
You are an independent contractor. Nothing here creates an employment relationship, partnership, joint venture, franchise, or agency. You cannot enter into contracts, make promises, accept payments, or handle support on our behalf, and you must not present yourself as able to.
You cover your own costs of promoting us. We do not reimburse ad spend, content production, or anything else you choose to invest.
If we share non-public information with you, such as unreleased features, pricing plans, or program data, keep it confidential and use it only to promote us.
11. Privacy and data
To run the program we process the details you give us and the referral activity on your links, using a third-party affiliate tracking platform as our processor. How we handle personal data is set out in our Privacy Policy and Data Privacy notice.
We report your own earnings to you. We do not give you personal data about the customers you refer, and you must not try to obtain it. If you collect personal data yourself, for example email addresses for a list you use to promote us, you are the controller of that data and responsible for collecting it lawfully, with proper notice and consent.
12. Changes to the program
We may change these terms, the commission rate, the cookie window, the payout threshold, or any other part of the program. When a change materially affects what you earn, we will give you reasonable notice by email or in your dashboard before it takes effect.
Changes apply going forward. Commission already earned on a sale that has happened is settled under the terms in place at the time of that sale. Continuing to use your referral link after a change takes effect means you accept the updated terms.
We may also suspend or close the program as a whole, with notice, and will pay approved commission earned up to that point.
13. Ending your participation
You can leave at any time by closing your affiliate account or by telling us at support@instawp.com. We can end your participation at any time, with or without cause, on notice to the email on your account.
When participation ends:
- Stop using your referral links, our marks, and our marketing assets.
- Approved commission already earned is paid out in the normal cycle, provided your balance has reached the $50 threshold and the account was not closed for a breach of these terms.
- Recurring commission stops. You do not continue to earn on customers you referred earlier.
- If we close your account for fraud or a serious breach, unpaid commission is cancelled and we may reclaim amounts already paid on affected referrals.
14. Disclaimers and liability
The program is provided on an "as is" and "as available" basis. We do not promise that tracking will be uninterrupted or error free, that any particular level of traffic will convert, or that you will earn any specific amount. Nothing we say about potential earnings is a guarantee.
To the fullest extent the law allows, InstaWP is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost data, or lost business opportunities arising out of the program. Our total liability to you for any claim connected with the program is limited to the commission properly owed to you and unpaid at the time the claim arose.
15. Indemnity
You agree to defend and indemnify InstaWP, its officers, employees, and contractors against any claim, loss, liability, and reasonable legal cost arising from your participation in the program, including your promotional activity and content, your breach of these terms, your misuse of our marks, and your handling of personal data.
16. General
These terms, together with the policies linked from them, are the whole agreement between you and us about the affiliate program. If any part is found unenforceable, the rest stays in force. Our not enforcing a term on one occasion does not waive it.
You cannot assign these terms without our written consent. We may assign them to an affiliate or successor in connection with a merger, acquisition, or sale of assets.
These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws rules. The state and federal courts located in Delaware have exclusive jurisdiction over any dispute arising out of them, and you consent to that jurisdiction. You are responsible for complying with the laws that apply where you are.
